EU Consultation on Unfair Trading Practices
We would like to inform you that the European Commission is conducting a consultation regarding the European Directive 2019/633 on unfair trading practices.
This consultation will help the European Commission to assess the impact of the Unfair Trading Practices Directive on the agricultural and food supply chain (“Unfair Trading Practices Directive”) and see what has happened in practice during the first years of its implementation.
In the agri-food chain, imbalances in bargaining power between suppliers and buyers of agricultural and food products can lead to unfair trading practices (UTPs) when larger and more powerful trading partners impose certain conditions and practices to the detriment of smaller suppliers. Such UTPs include late payments, cancellation at short notice or unilateral changes to the terms of supply.
The EU adopted the UTP Directive in 2019, while EU Member States were to transpose it by 1 May 2021 and apply it not later than 1 November 2021. You can find the 2021 National Regulation and the 2023 Amendment at the following links:
